SMS/MMS Mobile Message Marketing Program Terms and Conditions

By signing up for SMS marketing, you agree to receive recurring automated promotional and personalized marketing text messages (such as reminders) from BBS Computers at the cell number you provide. Reply HELP for assistance and STOP to cancel. Message frequency may vary, and standard message and data rates may apply. Review our Terms and Privacy Policy.

Program Description
BBS Computers (hereinafter, “We,” “Us,” or “Our”) offers a mobile messaging program (“Program”) which you agree to participate in subject to the following Terms and Conditions and Privacy Policy (“Agreement”). By opting into or participating in any of our Programs, you accept and agree to these terms, including your agreement to resolve disputes through binding individual arbitration, as detailed in the “Dispute Resolution” section below. This Agreement applies solely to the Program and does not modify other agreements or policies governing the relationship between you and Us.

User Opt-In
You may opt-in to the Program by signing up via online forms, applications, or other enrollment methods. By doing so, you consent to receive autodialed or prerecorded marketing messages at the phone number associated with your opt-in. Consent is not a condition of purchase. Message and data rates may apply.

User Opt-Out
To opt-out, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message received from Us. You may receive a confirmation message confirming your opt-out. These are the only reasonable ways to opt-out. Verbal requests or alternative messages are not valid means of opting out.

Change of Phone Number and Indemnity
If you plan to stop using the mobile phone number associated with your subscription to the Program, you agree to complete the opt-out process before discontinuing use of the number. If you fail to notify us and a third party acquires your number, you will be responsible for any claims or damages, including attorneys’ fees, incurred as a result. You agree to indemnify Us against any claims that arise from your failure to notify us of such changes.

Cost and Message Frequency
Message and data rates may apply. Messages will be sent periodically based on your interaction with Us, and frequency may vary.

For support, text HELP to the number you received messages from, or contact us at donnie@bbscomputers.net. Please note, this email is not for opting out; use the text-based commands for that purpose.

MMS Disclosure
If your device does not support MMS, messages will be sent as SMS.

Disclaimer of Warranty
The Program is provided "as-is" and may not always be available. We are not responsible for any delays or failures in message delivery, which are outside of Our control and dependent on your carrier. BBS Computers is not liable for any such delays.

Requirements
You must have a wireless device capable of two-way messaging and a participating carrier. Not all carriers support the service. Check your device and carrier for details.

Age Restriction
You must be at least 13 years old to use this Program. If you are between 13 and 18 years old, you must have your parent’s or guardian’s permission. By participating, you confirm that you meet the age requirement and have any necessary permissions.

Dispute Resolution
All disputes arising from or related to this Program shall be resolved by binding arbitration in Charleston, South Carolina, under the Commercial Arbitration Rules of the American Arbitration Association (AAA). Both parties waive any right to a jury trial or class action.

Miscellaneous
By participating, you warrant that you have the necessary rights and authority to agree to these Terms. If any provision is found to be invalid or unenforceable, the remainder of the Agreement will remain in full force. We may update these Terms from time to time, and your continued participation in the Program constitutes your acceptance of such changes.

Privacy Policy
We respect your privacy. Information collected through the Program will only be used for transmitting mobile messages and responses. We will not sell or share your information with third parties, except as required by law. By participating, you agree to provide accurate and truthful information.
